Earthquake Code-Local Law #17/95 - Building Separations

Purpose: 

To establish a uniform interpretation of Reference Standard RS 9-6, §2312(h)2.K.Building Separations enacted with Local Law #17/95.

Specifics: 

Section 2312(h)2.K. states in relevant part that "All structures shall be separated from adjoining structures."

This shall be interpreted to require a separation between any existing adjoining building or a building for which an excavation and foundation permit has been issued and such permit remains in effect, and any new building, including a horizontal or vertical enlargement of an existing building.

Such separation shall be provided to the full height of the adjoining building, including any bulkheads, penthouses, etc. which may be subject to the effect of pounding. Above the height of the adjoining building no separation is required.

In the case of a vertical enlargement of an existing building, the separation shall begin from the juncture of the new construction and the existing building.

EXEMPTED: 

Vertical extensions of existing party walls.
