The goal of the New York City Air Pollution Control Code (Air Code) (PDF) is to preserve, protect and improve the air resources of the City. The City’s policy is that every person be entitled to air that is not harmful to life, health and enjoyment of his or her property.

DEP’s Clean Air Tracking System (CATS) is an online process for submitting applications.

To obtain a Boiler Registration/Certificate of Operation, new applicants must register to create an account in CATS. To create an online account:

  • Register as a general user (owner/agent/licensed professional)
  • If you are a licensed Professional (PE, RA, LMP or LOBI); proceed with process to register for a Professional Role.

Accepted Boiler Equipment List DEP Boiler Equipment - List of equipment accepted by the DEP for use in NYC.
Equipment Approval Directive Equipment Approval Directive - as of August 1, 2017: DEP will no longer accept new equipment acceptance applications.
Compliance Certification Boiler and Burner Compliance Certification - Submitted by the filling PE to certify equipment (bare boiler, burner, assemblies, custom installation and control) not accepted by DEP will comply with all applicable regulations.
Custom Equipment Compliance Certification Form Custom Equipment Compliance Certification - Submitted by the filing PE to certify equipment not accepted by DEP will comply with all applicable regulations.
Stack Adequacy Form Draft calculations are required for a new boiler, induced draft fan or chimney and in accordance with the procedures in 2009 ASHRAE Fundamentals Chapter 21 and 2012 ASHRAE Systems and Equipment Chapter 35.

Annual Tune up Recordkeeping Form All boilers that are equal to or greater than 2.8 million Btu/hr must have annual tune-ups and records of the tune-up using these forms must be retained for a minimum of 5 years.

Letter of Authorization Owners need to provide a Letter of Authorization when changing a Professional Engineer, Registered Architect or Installer.
Installer Statement Installer must submit the Installer Statement when the installer is not named on the Work Permit Application form or the owner changed the Installer.

#4 Fuel Oil and Natural Gas Combustion Equivalent to #2 Fuel Oil for New Applications Fuel equivalency form is used for a dual fuel boiler to demonstrate that the annual emissions based on fuel consumption of natural gas and #4 fuel oil are equivalent to #2 fuel oil.

Method 9 Opacity Certification Method 9 Opacity Certification Method 9 Opacity Certification required for all generators regardless of EPA Tier. This form should be completed and attached with Inspection Request for original and triennial renewals through CATS. First timing filing of EPA Tier 4 or equivalent generators do not need an opacity certification. Generators permitted as a registration must conduct an opacity test but do not need to submit the results to DEP
