Important Information for Cigarette Retail Dealers

In July 2014, the Department of Consumer Affairs (DCA) held trainings for businesses to help them understand and comply with the new tobacco laws: Local Law 94 of 2013 (Tobacco 21) and Local Law 97 of 2013 (Sensible Tobacco Enforcement). Local Law 94 of 2013 – Tobacco 21
Effective Date: May 18, 2014
This law prohibits retailers from selling cigarettes, cigars, chewing tobacco, powdered tobacco, or other tobacco products or electronic cigarettes to customers under age 21. Retailers must post a new Age Restriction Sign*.

*The new Age Restriction Sign will be mailed to all New York City licensed Cigarette Retail Dealers prior to enforcement. Enforcement of Local Law 94 will begin on August 1, 2014.

Local Law 97 of 2013 – Sensible Tobacco Enforcement
Effective Date: March 19, 2014
This law establishes a price floor for cigarettes and little cigars, bans the redemption of discounts on cigarettes or tobacco products, and imposes a packaging requirement on cigars priced at $3 or less. This law also increases fines and penalties for cigarette retailers who engage in illegal activity, and requires cigarette retailers to post a sign* stating that valid New York State and New York City tax stamps must be on all cigarette packages sold in New York City. The law took effect on March 19, 2014, but the City will not begin enforcing the law until Rules are promulgated.

You must post the required Age Restriction and NYC/NYS Tax Stamp signs where you sell cigarettes so all customers can see it
