Health Violation Information

The Department of Health issues Health code violations to food service establishments, adult shops, and pet centers. 

As of July 5, 2011, New York City's Office of Administrative Trials and Hearings (OATH) oversees the response to these Notices of Violation through two of its Divisions: the Health Tribunal and the Environmental Control Board (ECB). Both the Health Tribunal and ECB are independent, administrative courts that are separate from the Department of Health.

The type of Notice of Violation (NOV) you received will determine if you will have to respond to the Health Tribunal or to ECB. You will find information about how to respond on your NOV.

The City offers food service establishments the opportunity to settle their violations in lier of having to wait at the Health Tribunal for their cases to be heard.
