Is it legal to smoke in the common outdoor area of a residential building?

In residential buildings, smoking is not allowed in common indoor areas like stairwells, laundry rooms, and lobbies. Smoking is permitted in private apartments and on sidewalks, as long as the smoking is not in an area with a child day care center or health care facility.
